We do not collect personal information about you unless you choose to provide that information to us or you choose a service on this website where gathering personal information is necessary to deliver the specific services. But use of those services is entirely voluntary.
Personal Information. Personal Information refers to information that lets us know the specifics of who you are. For example, our online inquiry forms may ask you to voluntarily provide contact information such as your name, email address, phone number, and mailing address. We do not collect any Personal Information about you unless you voluntarily provide it to us. Your Personal Information is used to provide services to you, to fill orders, and improve our product and service offerings. We may use Personal Information to deliver information to you and to contact you regarding administrative notices. We may also use your Personal Information to resolve disputes and troubleshoot problems.
Some pages may provide you with an opportunity to order products, make requests, and register to receive materials and/or services. The types of personal information collected on these pages may include: Business name, Contact name, E-mail address, Phone number, URL, Social Media links.
Non-personal Information. Non-personal information refers to information that we gather based upon how you use or visit our Site that does not by itself identify you specifically. Dear Birth uses cookies on the site but they are not used to record personal data. We have enabled Google Analytics Demographics and Interest Reporting which infers general demographic data (such as age, gender, and interests) on visitors but does not collect any personally identifiable information. The cookie feature is used only to store a randomly generated identifying temporary tag on your computer.
How about third party sites accessible from our Site?
We may disclose Personal Information when required by law or in the good-faith belief that such action is necessary in order to comply with the law or with a legal process served on our Site.
DearBirth retains the exclusive right to copy, edit and distribute any/all images created under this Model Release. That includes release to the general public, for any reason, including but not limited to: advertising, marketing, sales, print, competitions, educational seminars, and monetary gain. The mediums for display could include newspapers, magazines, books, television, and the internet, but are not limited to only those mediums. DearBirth retains these rights even if image files are turned over to the Client. All photos created by DearBirth are copyright protected.
It is a violation of federal copyright law to copy, scan, or allow photographs created by DearBirth to be reprinted, duplicated, digitally reproduced, copied, scanned, or altered digitally or otherwise without DearBirth’s express written permission. The client may print their personal photographs with the written consent of DearBirth once in possession of the digital images. The digital negatives or prints are for personal use and for the purposes of reproduction and giving of photographs to friends and relatives and not to be used by the client for profit.
The negatives/digital files remain the sole property of DearBirth and will never be given or sold.
Client grants DearBirth and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of Client, Client’s child or children, or in which Client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases DearBirth and its legal representatives and assigns from all claims and liability relating to said photographs. Unless differently writtenly stated and agreed upon.
Service Agreement and Liability Release
The client agrees that DearBirth shall provide Doula and photography services to the best of our abilities in accordance with the event selected. Every effort will be made to assure your satisfaction according to industry standards. Any artistic interpretations by the photographer will be deemed acceptable and correct. We will do all that we can to ensure that you are satisfied with your images and products. We cannot be responsible for dissatisfaction due to circumstances beyond our control. In the event that photographic materials are damaged or lost through camera or computer malfunction the photographer liability will be limited to a retake of the session whenever possible, a refund of the prorated for the amount of the exposures lost based on the percentage of total number of originals. If a fee must be refunded, DearBirth will have no further obligation to the client.
If DearBirth cannot perform this agreement in whole or in part due to a fire, casualty, acts of God, weather/nature, terror, or other causes beyond the control of the parties, DearBirth’s liability will be limited to scheduling a replacement session and producing the best images to our ability in that circumstance, and will not be responsible for dissatisfaction due to these circumstances that are beyond our control.
DearBirth provides two Doulas/photographers to ensure a secure replacement should illness or injury occur. The client understands that DearBirth will not be held responsible for any injuries, illnesses, etc. that may or may not derive from this session.
DearBirth will not tolerate any emotional, physical or verbal abuse. If an abusive situation arises at the reasonable discretion of the Doula/photographer, then the Doula/ photographer can leave and the retainer and any balance will be kept. If there is any issue with services provided, the client will not slander the Doula/photographer in any public form and will reach out to the Doula/photographer to address any concerns.
